All You Need to Know about the Flameproofing Affidavit

We all know what it’s like to have paper overload. It seems that everywhere we look, there’s more paper that needs to be scanned or file. Multiply that by a million for a business owner. However, one incredibly important piece of paper a business needs to have in order is the flameproofing affidavit. This piece of paper is not only a legal requirement but can also be the difference between life and death in a fire. Today, we’ll discuss some of the particulars for the affidavit for flame retardant treatment.


The affidavit for flame retardant treatment serves as proof that a business has met the flameproofing requirements set up by the FDNY.  That means that all required items have been soaked or sprayed with flame repellents, if they aren’t already inherently flame resistant. Objects that require treatment are as follows:


  • Objects that have previously failed a field flame test
  • Objects that have been treated in the past and require re-treatment
  • The effective time period of the chemicals has expired (or it’s been longer than 3 years)
  • Objects have been handled through washing or dry-cleaning and require re-treatment

In order for a flameproofing affidavit to be recognized by the FDNY, a C-15 Certificate of Fitness holder needs to issue it. Once received, the affidavit needs to be filed with the Bureau of Fire Prevention within 10 days. A copy of this record needs to be on site at the business as well. And to add to the paper records, any time the treated items have been dry-cleaned or washed needs to be tracked as well.

So what should a valid affidavit look like? These are the items you should see on your flameproofing affidavit:


  • The person or company who performed your treatment, his C-15 Certificate of Fitness holder number, and the date his certificate expires
  • The date of the flameproofing treatments
  • A detailed description of the items that received flameproofing treatments as well as a statement demonstrating only sanctioned treatments were in use
  • The chemicals’ field names, the manufacturers of the chemicals, and their Certificate of Approval numbers
  • A statement that FDNY regulations were observed and that the items passed the field flame test for non-combustibility 
  • The time period for the chemicals’ effectiveness

While it seems like more paperwork to the pile, the flameproofing affidavit is an incredibly important document. Fortunately, it’s not a lengthy or complicated process to have items on location treated with fire retardants and subsequently receive the affidavit of flame repellent treatment.
